Terms of Service

These terms cover your use of PhonePick, operated by Ted Kam Consulting Ltd. Using the service means you accept them.

What the service is

PhonePick provides a phone number, an automated assistant that answers calls and texts on your behalf, a call log with transcripts, appointment booking, and a message inbox. It is an assistant, not an employee and not an answering service staffed by people.

Your account

You need an account and you are responsible for what happens under it. Tell us promptly if you think someone else has access.

Plans, minutes and messages

• Plans are billed monthly in advance and include a set number of answered minutes and outbound text segments. Both reset on the first of each month and do not carry over.
• A call is rounded up to the next whole minute, the way the carrier bills it.
• A long text message is sent as more than one segment and counts as more than one.
• When your minutes run out we stop answering and calls ring through to the phone number you nominated. We do not answer calls you have not paid for, so you will not receive a bill for minutes you did not buy.
• When your text allowance runs out, automatic messages stop. You can still reply by hand from your inbox.
• Cancel any time. The plan runs to the end of the period you have paid for. We do not give partial refunds for unused minutes.

Rules you have to follow

You are responsible for how the service is used on your line. You agree not to:

• Send marketing texts to people who have not agreed to receive them, or text any number that has replied STOP.
• Use PhonePick for unsolicited bulk calling or messaging of any kind.
• Configure the assistant to claim it is a human being, or to state prices, guarantees or commitments you are not willing to stand behind.
• Record calls where doing so without the caller's consent is unlawful.
• Use the service for anything illegal, or for emergency services of any kind.

PhonePick is not an emergency service. It cannot call 911 and must never be relied on for anything where a delay could cause harm.

Messaging registration

US carriers require every business sending text messages to be registered before messages will be delivered. You agree to give accurate information for that registration. We submit it on your behalf; we do not control whether carriers approve it or how long they take.

Your data

Your call records, transcripts, messages and contacts are yours. You can export them while your account is open. We handle them as described in our Privacy Policy.

What we do not promise

The service depends on telephone carriers, internet providers and third-party software, and none of them is perfect. An automated assistant can mishear a name, miss a nuance or take a message imperfectly. We provide PhonePick as it is, without warranties beyond those the law gives you and does not let us exclude. We do not promise uninterrupted service, and we do not promise the assistant will never make a mistake.

Limits on liability

To the extent the law allows, our total liability for any claim relating to the service is limited to what you paid us in the three months before the claim. We are not liable for lost business, lost profits or missed opportunities.

Suspension

We may suspend an account that breaks these rules, that is not paid, or that is causing harm to the phone network or to other customers. Where we reasonably can, we will warn you first.

Changes

We may update these terms and will email account holders before material changes take effect. Continuing to use PhonePick after that means you accept the new terms.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have exclusive jurisdiction.
