Affiliate terms

These terms cover the PhonePick affiliate program, run by Gintii AI Inc. (“we”, “us”). You (“you”, the affiliate) accept them when you join. The businesses you refer use PhonePick under its own Terms of Service. The program in plain words is on the affiliate page.

Joining

• You apply by email to support@phonepick.ai. We may accept or decline any application, and don’t have to give a reason.
• You must be at least 18, or a registered business, and promote PhonePick to businesses in Canada or the United States.
• One affiliate account per person or company.

Your code

When you join we give you your own code. A business enters it when it checks out its first paid plan. The code takes 10% off that business’s first month and records the business as referred by you. It is the only way we count a referral: a business that signs up without your code can’t be added later.

What counts as a referral

A business counts as your referral when all of these are true:

• it has never had a paid PhonePick plan before;
• it entered your code at its first paid checkout;
• it is not you, your own company, or a business you own or control.

Your commission

You earn 22% of each payment a business you referred makes for its PhonePick plan during its first 12 months, counted from its first paid checkout. The 22% is of what the business actually paid for the plan, after any discount and before tax, in the currency it paid in.

These don’t count toward your commission:

• add-ons, such as outbound calling, extra logins, extra numbers and the CRM;
• one-time packs;
• tax;
• payments that are refunded or charged back, and anything paid with credit rather than money.

After a business’s first 12 months, you earn nothing further on it. A business that cancels and comes back later does not start a new 12 months.

Getting paid

• We pay commission monthly. A payment counts once it is 30 days old.
• Each payout comes with a statement of the payments it covers.
• We agree how we pay you, and in which currency, when you join.
• If a payment we have already paid you on is later refunded or charged back, we may take that commission off your next payout.
• You are responsible for any tax on what you earn. If you are registered for sales tax, such as GST/HST, tell us and we will work out how to show it.

How you may promote PhonePick

You may recommend PhonePick on your website, in newsletters, videos and social posts, and to your own clients and members. When you do:

• Say you earn a commission, clearly, wherever you recommend PhonePick in public.
• Say what it is. PhonePick is an AI, and every call it answers opens by saying so. Never present it as a person, or as something callers won’t notice.
• Claim only what it does. Say nothing about PhonePick’s features, prices, compliance or results that isn’t on phonepick.ai, unless we have agreed it with you in writing.
• Follow anti-spam law: Canada’s anti-spam law (CASL) and US rules. No bought or rented lists, and no messages to people who haven’t agreed to hear from you.

You may not:

• bid on “PhonePick”, or anything close to it, in search ads, or use it in a domain name, social account or ad account;
• present yourself as PhonePick or Gintii AI, or say you speak for us;
• post your code on coupon or deal sites;
• use your own code, or have someone sign up for you, to earn commission on your own business.

Our name and logos

You may use the PhonePick name, logos and copy from the affiliate kit only to promote PhonePick, and only as provided. We may ask you to change or take down anything that uses them, and you agree to do so promptly.

Breaking these terms

If we reasonably believe you have broken these terms, we may hold commission while we look into it, and we won’t pay commission earned by breaking them. We may also end your place in the program straight away.

Changes, and ending

• We may change these terms or the commission rate. We will email you at least 30 days before a change takes effect. A change never reduces commission on payments made before it.
• You or we may end your place in the program at any time, by email.
• When it ends, we still pay commission on payments made before the end date, once each is 30 days old, unless it ended because you broke these terms.

The relationship

You are independent. Nothing in the program makes you our employee, agent or partner in law, and you can’t make promises or agreements on our behalf.

Limits

The program is provided as it is. We aren’t liable to you for indirect losses or lost profits, and our total liability to you under the program is limited to the commission we owe you.

Law

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there.
